Chief Secretary Message

Comprehensive reform of the criminal justice system in Pakistan can no Ionger be ignored by the state or society. This Rule of Law Roadmap aims at laying the foundation of urgently needed reforms in our criminal justice system. The driving spirit and guiding principle of this Roadmap has been to improve service delivery of all institutions in the justice chain. The province of Khyber Pakhtunkhwa has always demonstrated greater receptivity to new initiatives and reforms. This Roadmap ensures that our legal and judicial structures develop from within and that reforms are introduced through a process that allows for the acceptability of change. All concerned departments and stakeholders have been involved in this process, from its inception to its completion.

This Roadmap is the product of a collaborative and inclusive effort that requires active participation from the entire government for its successful implementation. As a sustainable and evolving Roadmap, one that allows progression over time, this document will play a crucial part in institutional reform.

Provision of security to the life and property of all members of the society is the foremost duty of every government. Khyber Pakhtunkhwa is passing through one of the most difficult phases in its history as the menace of militancy has played havoc with the lives and properties of ordinary people. It is also a proven fact that poor governance and lack of the rule of law create an enabling environment for radicalization. This situation warrants a pragmatic and sustained program, which can effectively counter the threat of militancy and turn the province into a safe and prosperous place by strengthening the writ of the government on every inch of the provincial territory. In this context, the Home Department has a leading role as it is the parent department of law and justice enforcement institutions such as the Police, Prosecution, Prisons, Probation and Directorate of Public Safety Commission. Being mindful of this role, the Home Department has developed an integrated programme for provision of institutional and capacity development so that effective and speedy service delivery is ensured at the grass root level. The strategic plan, on one hand, aims at equipping all these departments with the latest technologies and infrastructure support and on the other hand also provides for human capacity building for optimal performance. Alongside that, the Home Department is also working on amending the existing laws and introducing new laws to fill the gaps in the current legal regime. I am grateful to the Honourable Chief Minister and the Chief Secretary for their enthusiastic support and guidance. Under their insightful leadership, the Home Department aims to establish a living environment in the Khyber Pakhtunkhwa where life, honour, and liberties of the people are fully secured. I strongly believe that by strengthening the law and justice enforcement institutions we can achieve our goal of a safer and more secure Khyber Pakhtunkhwa where ordinary people can enjoy a peaceful and prosperous life.

The Home and Tribal Affairs Department occupies a central position regarding law and order issues of the Province. It is a prime policy making organization when it comes to Peace Building and Rule of Law. Police and civil administration at divisional and district level are the implementing arms of Home department. Historically, Home and Tribal Affairs department has played a strategically important role in maintaining law and order and giving policy directions to its implementing arms. The role and importance of Home Department had increased manifold especially after the former USSR invasion of Afghanistan. The Province of Khyber Pakhtunkhwa remained a front line corridor in USSR-Afghan War for resisting the forces. Home department had to deal with the influx of millions of Afghan Refugees in the wake of Afghan Jihad. Such cross border migration have had socio-politico and economic repercussions for Khyber Pakhtunkhwa. Home department stood up with professional zeal to meet all those challenges in a befitting manner. Home department successfully managed the impacts of USSR troops withdrawal from Afghanistan. The tragedy of 9/11 significantly changed the security dynamics of the world. Once again, the Province of Khyber Pakhtunkhwa assumed the role of front line corridor in the war against international terrorism. The 9/11 incident shifted the tectonic plates of Holy War and the Jihadis of yesteryears became international terrorists. America, alongwith her allies jumped into the fray and initiated military action under the UN umbrella in Afghanistan in 2001 in pursuit of Al-Qaida and Taliban. This decade old war against terrorism has severe repercussions for the Province of Khyber Pakhtunkhwa. The misled elements inspired from Al-Qaeda and Taliban in Afghanistan have established their strongholds in certain parts of FATA. Ultimately, it resulted in the shape of a Jihadi movement with the name of Tehrik-e-Taliban Pakistan (TTP). The TTP during all these years have carried out ferocious attacks on civilians, mosques, public places, police, paramilitary forces and law enforcement agencies in FATA and Khyber Pakhtunkhwa. Thousands of innocent people have so far died as a result of these attacks. Apart from human loss, material loss worth billions of rupees has also been born by provincial government. The emergence of TTP has out rightly changed the security dynamics in Khyber Pakhtunkhwa. There has been a phenomenal rise in suicide attacks, IEDs blasts, kidnapping for ransom and extortion. Keeping in view the changed security scenario in Khyber Pakhtunkhwa, Home department has also chalked out its security strategy. In order to cope with these challenges, Police department has been transformed into modern fighting force having its own specialized combat, intelligence and investigation departments in the shape of Counter Terrorism Department (CTD), creation of Elite Force and Rapid Response Force. Similarly, new Prisons Security Force has been raised to deal with changed security scenario. Home department has close liaison with Armed forces and other Paramilitary forces to combat the menace of terrorism, kidnapping for ransom, extortion and suicide attacks. Keeping in view the above discourse regarding prevailing law and order situation and changed security dynamics in Khyber Pakhtunkhwa and FATA, greater responsibility rests on Home department. It demands ever vigilance and state of preparedness. Home department will strive hard to attain the desired vision of attaining a secure, just and prosperous society.
